1. Introduction

Welcome to OwlWho (“OwlWho,” “we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of OwlWho’s websites, software, tools, and applications (the “Service”).

By creating an account or using the Service, you agree to be bound by these Terms. OwlWho may modify these Terms at any time. Continued use of the Service constitutes acceptance of updated Terms.

2. Eligibility

The Service may be used by students, educators, and general users.

  • Under age 13: parental or educator consent required
  • Under age 18: you represent your parent or guardian reviewed and accepted these Terms

If you are using the Service on behalf of a school or institution, you represent and warrant you have authority to provide consent for student usage.

3. Accounts & Access

To access certain features, you must create an account. You are solely responsible for maintaining login security, all activity on your account, and accuracy of information provided.

Users may request account deletion by emailing support: aj@owlwho.net. You may not share login credentials or access accounts belonging to others.

4. Privacy & Student Data

OwlWho respects user privacy and complies with applicable student privacy laws including FERPA and COPPA. We collect limited personal data for operating and improving the Service. OwlWho uses secure infrastructure including encryption, secure data storage, and industry-standard security practices.

Parents who believe a child submitted information without consent may request deletion.

5. Acceptable Use

Users may not violate laws, submit harmful, violent, or abusive content, attempt unauthorized access, reverse engineer the Service, or interfere with Service functionality.

Users may not artificially inflate usage, including excessive messaging, automated inputs, repeated meaningless characters, or bot-like behavior. OwlWho may suspend, throttle, slow, or terminate access for any violation.

6. Abuse, Spam & Automated Protection

To maintain system performance, OwlWho may automatically detect and limit behavior including repeated meaningless messages, spamming text (“aaaa….”), random characters, repeated greetings, excessive requests, or bot attempts. If detected, OwlWho may throttle, block, suspend, terminate accounts, or permanently ban abuse. Continuation may result in termination without refund.

7. Fair Use Policy

OwlWho operates under a fair-use standard. If usage exceeds reasonable expectations, OwlWho may apply slower responses, message limits, queueing, or temporary suspension. Free, Plus, and Unlimited plans have different resource access. “Unlimited” means reasonable use and is not infinite. OwlWho may determine fairness at its sole discretion.

8. AI-Generated Content

OwlWho provides automated educational AI tools. AI-generated content may contain errors, may be incomplete, and is not professional academic advice. Users are responsible for verifying accuracy and following academic rules. You may not use the Service to cheat, plagiarize, or violate school policy.

9. Intellectual Property

All rights, trademarks, materials, and technology associated with OwlWho are owned by OwlWho. Users retain ownership of personal uploads and user-generated content. Users may not reproduce, modify, or distribute OwlWho intellectual property without written permission.

10. Payments, Billing & Subscriptions

Payments are processed through Stripe. Subscriptions are non-refundable except where required by law; pricing may change; plans auto-renew until canceled. EU/UK/Turkey users may request a refund within 14 days per applicable laws.

11. Cancellation & Termination

You may cancel at any time through account settings. Canceling stops future billing, but does not automatically issue a refund. OwlWho may suspend or terminate accounts for misuse, nonpayment, policy violations, or excessive usage.

12. API Usage Limits

OwlWho uses third-party AI and search providers including OpenAI, Google, Tavily, and others. OwlWho may block usage, restrict features, limit requests, enforce quotas, and apply daily caps. OwlWho is not responsible for limitations imposed externally.

13. Rate Limit Disclosure

Plans include different access levels and may include limits per request, per day, per month, or per number of messages. OwlWho may slow responses, enforce queues, temporarily lock accounts, throttle requests, force logout, or suspend.

14. Data Overload & Excessive Usage

Users may not overload the system including random character spam, automated scripts, repetitive meaningless messages, or high-frequency non-educational usage. OwlWho may immediately limit, suspend, or terminate abusive accounts.

15. AI Safety Routing

OwlWho may filter, block, or reject content due to model safety policies, moderation requirements, prohibited topics, or platform compliance. Some prompts may always be blocked regardless of plan level.

16. Plan-Based System Restrictions

Plans may differ in speed, performance level, model availability, usage limits, queue priority, and available features. Free plans may include slower responses, fewer messages, reduced access, and disabled tools. “Unlimited” usage means reasonable use, not infinite.

17. Automated Throttling & Slow Mode

OwlWho may throttle usage, slow responses, queue requests, deny requests, block usage, or apply waiting mode. Repeated violations may result in suspension, removal of chat history, permanent account closure, and no refund.

18. Security & Breaches

If OwlWho becomes aware of a security incident, OwlWho will investigate, notify users when legally required, and cooperate with authorities if appropriate.

19. Limitation of Liability

The Service is provided “as is.” OwlWho is not liable for errors, outages, academic consequences, lost data, indirect or consequential damages, or misuse by users.

20. Indemnification

You agree to indemnify OwlWho for claims related to your usage, your uploads, and policy violations.

21. Governing Law

These Terms are governed by the laws of the United States and the State of Pennsylvania.
